Acceptance
By using this website you agree to these terms. If you do not agree with them, please do not use the site. These terms cover this website only. Other services you may reach from here, including the Finaya application, are operated separately and have their own terms.
Please read the dispute resolution section carefully. It requires most disputes between us to be resolved by binding individual arbitration rather than in court, and it waives your right to a jury trial and to take part in a class action. You may opt out of arbitration within 30 days, and doing so costs you nothing else under these terms.
Not a commitment, and not advice
Finaya Home Loans is a mortgage broker, not a lender. Nothing on this website is a commitment to lend, an offer of credit, an approval, or a rate lock, and no figure shown here is a quote. Loans are made by third-party lenders and remain subject to their underwriting, credit approval, property appraisal and conditions.
Content here is general information. It is not legal, tax, accounting, investment or financial advice, and it does not take account of your circumstances. Any calculator, example or scenario is illustrative.

Using the site
You may use this website for your own personal, non-commercial purposes. You agree not to:
- Use the site for any unlawful purpose, or in a way that infringes anyone else’s rights.
- Attempt to gain unauthorised access to the site, its servers, or any connected system.
- Interfere with the operation of the site, including by scraping at a rate that degrades it, or by circumventing security or rate limits.
- Copy, republish or redistribute the site’s content for commercial purposes without our written permission.
- Submit anything false or misleading, or impersonate another person.
Text messages
Finaya Home Loans Alerts is our text message program. If you give us your mobile number and opt in, we send you periodic messages about the loan you are working on with us.
What we send:
- Updates about your loan application and its progress.
- Rate alerts.
- Other updates relevant to the loan you are working on with us.
Message frequency varies with your preferences and your account activity. Standard message and data rates may apply; those are charged by your mobile carrier, not by us.
Consenting to text messages is not a condition of any purchase, and it is not a condition of applying for or obtaining a loan. You can decline, or opt out later, and it will not affect your application.
To stop messages, text STOP to 803-526-7190 at any time. You will receive one message confirming that you have been unsubscribed, and after that we will send you no further messages.

Delivery is not guaranteed. Mobile carriers are not liable for delayed or undelivered messages.

Intellectual property
The content, design, text and graphics on this site are owned by NBI Financial Group LLC or its licensors and are protected by copyright and trademark law. The Finaya Home Loans name and logo may not be used without permission.
Third-party names and marks appearing on this site, including those of lenders and service providers, belong to their respective owners.
Third-party links and services
This site links to services we do not control, including the main Finaya application, our job board, and external sites such as NMLS Consumer Access. We are not responsible for their content, availability, terms or privacy practices, and a link is not an endorsement.
Where a provider has a relationship with us, see our affiliated business disclosure. You are free to shop for providers.
Availability and accuracy
We try to keep this site accurate and available, but we do not promise that it will be uninterrupted, error-free, or current. Rates, programs, terms and eligibility change without notice, and information supplied by third parties may be incomplete or out of date.
The site is provided on an “as is” and “as available” basis, without warranties of any kind, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, NBI Financial Group LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunity or loss of goodwill, arising from your use of, or inability to use, this website. This applies even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total liability for all claims relating to this website will not exceed one hundred US dollars ($100). This website is provided free of charge, and that amount reflects it.
Nothing in these terms limits or excludes liability that cannot lawfully be limited or excluded. That includes liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, and any liability or remedy under consumer protection, fair lending or mortgage licensing law. Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
Indemnity
If you use this website in a way these terms prohibit — unlawfully, to infringe someone else's rights, to gain or attempt unauthorised access, to interfere with the site's operation, or by impersonating another person — and a third-party claim against us results, you agree to indemnify NBI Financial Group LLC for the reasonable costs, damages and legal fees we incur because of it.
This applies only to claims caused by that conduct. It does not apply to ordinary use of this website, and it does not apply to the extent a claim arises from our own acts or omissions. We will tell you promptly of any claim we expect you to cover, and we keep control of our own defence and will not settle a claim on your behalf without your agreement.
Accessibility

Dispute resolution and arbitration
This section affects your legal rights. It requires individual arbitration and waives jury trials and class actions. You may opt out within 30 days.
Talk to us first. Most problems are settled fastest by telling us about them. Before starting arbitration, please send a description of the dispute and the resolution you want to legal@finayahl.com or to the address at the foot of this page. We will do the same. If it is not resolved within 60 days, either of us may begin arbitration.
Agreement to arbitrate. You and NBI Financial Group LLC agree that any dispute arising out of or relating to this website or these terms will be resolved by binding individual arbitration rather than in court. This agreement is governed by the Federal Arbitration Act.
What is not covered. Either of us may bring a qualifying claim in small-claims court instead of arbitration. Either of us may also ask a court for an injunction to stop unauthorised access to, or misuse of, the site or our intellectual property. Nothing here prevents you from reporting a matter to a government agency, or stops that agency from acting.
How arbitration works. Arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules, available at adr.org. Those rules cap what you pay to file and set where the hearing is held, which for a consumer is the county where you live. One arbitrator decides, applies the same law a court would, and must give a written decision. The decision may be entered as a judgment in any court with jurisdiction.
Individual claims only. Claims must be brought individually. Neither of us may bring a class, collective, consolidated or representative action, and the arbitrator may not preside over one or award relief to anyone who is not a party. If this paragraph is found unenforceable as to a particular claim, then this entire dispute resolution section does not apply to that claim, and that claim proceeds in court under the governing law and venue section below.
Many similar claims at once. If 25 or more demands for arbitration raising substantially the same claims are filed by or with the coordination of the same lawyers, they will be administered in staged batches of up to 50, each batch decided by one arbitrator, with the remaining demands held until the preceding batch resolves. This paragraph is severable: if it is found unenforceable, the rest of this section still applies.
How to opt out. You may reject this arbitration agreement by writing to legal@finayahl.com, or to the address at the foot of this page, within 30 days of first using this website. Include your name and the fact that you are opting out of arbitration; no reason is needed. Opting out affects nothing else in these terms, and we will not treat you differently for it. If you opt out, disputes between us proceed in court under the section below.
This section survives the end of your use of this website. If any part of it other than the paragraph on individual claims is found unenforceable, the rest of the section continues to apply.
Governing law and venue
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except where the law of your state of residence applies and cannot be varied by agreement.
Where a dispute goes to court rather than arbitration, it must be brought in the state or federal courts located in the State of Delaware, and both of us consent to those courts. This does not apply to a claim brought in small-claims court, which may be brought where you live, and it does not displace any right you have under the law of your state of residence to bring a claim there.
Changes
We may update these terms. The date at the top of this page shows when they last changed, and continued use of the site after a change means you accept the updated terms.
A change to the dispute resolution section does not apply to any dispute we already knew about when the change was made.
